I hereby acknowledge the Wonders & Worries Waiver detailed below, and I accept the terms of the waiver and provide a digital signature for the Wonders & Worries Waiver.
Wonders & Worries Waiver
I acknowledge that I am attending or participating in the No Worries Classic to be held at Reunion Ranch. I desire to participate in or be in close proximity to the shooting and other activities associated with this event and understand that the execution and delivery of this release of liability is a condition to my right to participate or attend.
ASSUMPTION OF RISK. I further Acknowledge and Understand That No Warranty, Either Express or Implied, Is Made by Wonders & Worries or Reunion Ranch or any other person or entity as to the condition of any roads, buildings, gates, or other improvements on the Reunion Ranch, that dangerous conditions do exist and that this document is sufficient warning that there are numerous dangerous conditions, risks, and hazards involved in the shooting and other activities associated with the No Worries Classic. The activities that I desire to undertake at the No Worries Classic will expose me and my property to numerous dangerous conditions, risks and hazards including, But Not Limited To the intentional or accidental discharge of firearms by myself and others with its inherent risk of possible bodily injury or death; poisonous snakes, insects, and spiders; erosion and general condition of the land both on and off roadways or scenarios creating rough, hazardous, and dangerous driving and walking conditions; animals both wild and domestic, which may be diseased and/or potentially dangerous. I further hereby state that I expressly assume all such risks, hazards, and dangers with the understanding that I am exposing both my person and my property to same. I will not participate in any activity that I believe poses an undue risk to me or that makes me uncomfortable.
GENERAL RELEASE. In consideration of my right to attend or participate in the No Worries Classic and to enter Runion Ranch to attend or participate in that event, I DO HEREBY RELEASE WONDERS & WORRIES, REUNION RANCH), AND EACH OF THEIR RESPECTIVE SHAREHOLDERS, PARTNERS, DIRECTORS, OFFICERS, TRUSTEES, BENEFICIARIES, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS AND ASSIGNS (COLLECTIVELY THE “RELEASED PARTIES”) FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, OR CAUSES OF ACTION OF ANY KIND THAT I COULD BRING OR ASSERT OR THAT COULD BE BROUGHT BY MY HEIRS, REPRESENTATIVES, SUCCESSORS OR ASSIGNS (“MY RELATED PARTIES”), AND FROM ANY LOSS EXPENSE OR DAMAGE, INCLUDING BUT NOT LIMITED TO DAMAGE TO PROPERTY, BODILY INJURY, WRONGFUL DEATH, ATTORNEY FEES AND COURT FEES THAT I OR ANY OF MY RELATED PARTIES SUFFER, RESULTING FROM ANY ACCIDENT, INCIDENT OR OCCURANCE ARISING OUT OF, INCIDENTAL TO OR IN ANYWAY RESULTING FROM MY ATTENDANCE AT OR PARTICIPATION IN THE NO WORRIES CLASSIC AT REUNION RANCH REGARDLESS OF WHETHER SAME ARE DIRECTLY OR INDIRECTLY CAUSED BY OR RELATED TO THE NEGLIGENCE OR GROSS NEGLIGENCE OF ANY OF THE RELEASED PARTIES. I HEREBY FURTHER COVENANT AND AGREE FOR MY RELATED PARTIES THAT I WILL NOT MAKE ANY CLAIM OR INSTITUTE ANY SUIT OR ACTION AT LASW OR IN EQUITY AGAINST ANY OF THE RELEASED PARTIES.
INDEMNIFICATION. In further consideration my right to attend or participate in the No Worries Classic and to enter Reunion Ranch to attend or participate in that event, I HEREBY AGREE TO IDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, OR CAUSES OF ACTION OF ANY KIND ASSERTED OR BROUGHT AGAINST ANY OF THEM, AND ANY LOSS, EXPENSES AND DAMAGES, INCLUDING, BUT NOT LIMITED TO DAMAGE TO PROPERTY, BODILY INJURY, WRONGFUL DEATH, ATTORNEYS FEES AND COURT AND SETTLEMENT COSTS INCURRED OR SUFFERED BY ANY OF THEM AND DIRECTLY OR INDIRECTLY RESULTING FROM ANY ACCIDENT, INCIDENT, OR OCCURRENCE ARISING OUT OF, INCIDENTAL TO, OR IN ANYWAY RESULTING FROM MY ATTENDANCE AT OR PARTICIPATION IN THE NO WORRIES CLASSIC REGARDLESS OF WHETHER THE CLAIM, DEMAND, DAMAGE CAUSE OF ACTION EXPENCE OR LOSS ARE DIRECTLY OR INDIRECTLY CAUSED BY OR RELATED TO THE NEGLIGENCE OR GROSS NEGLIGENCE OF ANY OF THE RELEASED PARTIES.
MEDICAL TREATMENT. I hereby authorize any representative of Wonders & Worries to have me treated in any medical emergency during my participation in the No Worries Classic. Further, I agree to pay all costs associated with medical care and transportation.
COVID-19 WARNING. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death. Wonders & Worries cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while participating in the No Worries Classic.
COVID-19 RELEASE. I HAVE READ AND UNDERSTOOD THE ABOVE WARNING CONCERNING COVID-19. I HEREBY CHOOSE TO ACCEPT THE RISK OF CONTRACTING COVID-19 THROUGH MY PARTICIPATION IN THE NO WORRIES CLASSIC. I RELEASE AND WAIVE MY RIGHT TO BRING SUIT AGAINST WONDERS & WORRIES AND TDS EXOTIC GAME RANCH AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, MANAGERS, OFFICIALS, AGENTS, EMPLOYEES, OR OTHER REPRESENTATIVES IN CONNECTION WITH EXPOSURE, INFECTION, AND/OR SPREAD OF COVID-19 RELATED TO PARTICIPATION IN THE NO WORRIES CLASSIC. I UNDERSTAND THAT THIS WAIVER MEANS I GIVE UP MY RIGHT TO BRING ANY CLAIMS INCLUDING FOR PERSONAL INJURIES, DEATH, DISEASE OR PROPERTY LOSSES, OR ANY OTHER LOSS, INCLUDING BUT NOT LIMITED TO CLAIMS OF NEGLIGENCE AND GIVE UP ANY CLAIM I MAY HAVE TO SEEK DAMAGES, WHETHER KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN.
I have made the decision to use the Reunion Ranch property and to participate or attend the No Worries Classic after carefully considering the risks acknowledged above.
I HAVE READ THIS RELEASE AND LIABILITY, I UNDERSTAND THAT I AM RELEASING CERTAIN RIGHTS AND CLAIMS, AND INDEMNIFYING THE RELEASED PARTIES BY SIGNING IT, AND I AM FREELY DOING SO.
