Release of Liability and Acknowledgment and Acceptance of Risks, Hazards and Dangers
I acknowledge that I am attending or participating in the Wonders & Worries Urban Scavenger Hunt to be held at various locations in the City of Austin and the surrounding area. I desire to participate in or be in close proximity to the activities associated with this event and understand that the execution and delivery of this release of liability is a condition to my right to participate or attend.
I further Acknowledge and Understand That No Warranty, Either Express or Implied, Is Made by Wonders & Worries or any other person or entity as to the condition of any roads, buildings, gates, or other improvements on any premises or area on which the events of the Urban Scavenger Hunt may take place, that dangerous conditions do exist and that this document is sufficient warning that there are numerous dangerous conditions, risks, and hazards involved in the activities associated with the Urban Scavenger Hunt. The activities that I desire to undertake at the Urban Scavenger Hunt will expose me and my property to risk of injury and to numerous dangerous conditions, risks and hazards including, But Not Limited To; poisonous snakes, insects, and spiders; erosion and general condition of the land both on and off roadways or scenarios creating rough, hazardous, and dangerous driving and walking conditions; animals both wild and domestic, which may be diseased and/or potentially dangerous. I further hereby state that I expressly assume all such risks, hazards, and dangers with the understanding that I am exposing both my person and my property to same. I will not participate in any activity that I believe poses an undue risk to me or that makes me uncomfortable.
In consideration for my right to attend or participate in the Wonders & Worries Urban Scavenger Hunt, I DO HEREBY RELEASE Wonders & Worries, its shareholders, partners, directors, officers, trustees, beneficiaries, employees, agents, affiliates, successors and assigns (collectively the “Released Parties”) from and against any and all claims, demands, or causes of action of any sort that I could bring or assert or that could be brought by my heirs representatives, successors or assigns (“My Related Parties”), and from any loss, expense or damage, including, but not limited to damage to property, bodily injury, wrongful death, attorney fees and court costs that I or any of My Related Parties suffer, resulting from any accident, incident, or occurrence arising out of, incidental to, or in anyway resulting from my attendance at or participation in the Urban Scavenger Hunt regardless of whether same may result from the negligence or gross negligence of any of the Released Parties. I hereby further covenant and agree for My Related Parties that I will not make any claim or institute any suit or action at law or in equity against any of the Released Parties.
In further consideration my right to attend or participate in the Urban Scavenger Hunt, I HEREBY AGREE TO IDEMNIFY, AND HOLD HARMLESS THE RELEASE PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, OR CAUSES OF ACTION OF ANY SORT ASSERTED OR BROUGHT AGAINST ANY OF THEM, AND ANY LOSS, EXPENSES AND DAMAGES, INCLUDING, BUT NOT LIMITED TO DAMAGE TO PROPERTY, BODILY INJURY, WRONGFUL DEATH, ATTORNEYS FEES AND COURT AND SETTLEMENT COSTS INCURRED OR SUFFERED BY ANY OF THEM AND RESULTING FROM ANY ACCIDENT, INCIDENT, OR OCCURRENCE ARISING OUT OF, INCIDENTAL TO, OR IN ANYWAY RESULTING FROM MY ATTENDANCE AT OR PARTICIPATION IN THE WONDERS & WORRIES URBAN SCAVENGER HUNT REGARDLESS OF WHETHER THE CLAIM, DEMAND, DAMAGE CAUSE OF ACTION EXPENCE OR LOSS MAY RESULT FROM THE NEGLIGENCE OR GROSS NEGLIGENCE OF ANY OF THE RELEASED PARTIES.
COVID-19 WARNING. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death. Wonders & Worries cannot prevent you or your child(ren) from becoming exposed to, contracting, or spreading COVID-19 while participating in the Wonders & Worries Urban Scavenger Hunt.
COVID-19 RELEASE. I HAVE READ AND UNDERSTOOD THE ABOVE WARNING CONCERNING COVID-19. I HEREBY CHOOSE TO ACCEPT THE RISK OF CONTRACTING COVID-19 FOR MYSELF AND/OR MY CHILD(REN) THROUGH MY AND/OR MY CHILD(REN)’S PARTICIPATION IN THE WONDERS & WORRIES URBAN SCAVENGER HUNT. I RELEASE AND WAIVE MY RIGHT TO BRING SUIT AGAINST WONDERS & WORRIES AND EACH OF THEIR OFFICERS, DIRECTORS, MANAGERS, OFFICIALS, AGENTS, EMPLOYEES, OR OTHER REPRESENTATIVES IN CONNECTION WITH EXPOSURE, INFECTION, AND/OR SPREAD OF COVID-19 RELATED TO PARTICIPATION IN THE WONDERS & WORRIES URBAN SCAVENGER HUNT. I UNDERSTAND THAT THIS WAIVER MEANS I GIVE UP MY RIGHT TO BRING ANY CLAIMS INCLUDING FOR PERSONAL INJURIES, DEATH, DISEASE OR PROPERTY LOSSES, OR ANY OTHER LOSS, INCLUDING BUT NOT LIMITED TO CLAIMS OF NEGLIGENCE AND GIVE UP ANY CLAIM I MAY HAVE TO SEEK DAMAGES, WHETHER KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN.
I have made the decision to participate or attend the Urban Scavenger Hunt after carefully considering the risks acknowledged above.
I HAVE READ THIS RELEASE AND LIABILITY, I UNDERSTAND THAT I AM RELEASING CERTAIN RIGHTS AND CLAIMS, AND INDEMNIFYING THE RELEASED PARTIES BY ACKNOWLEDGING IT.
Photo Release
Wonders & Worries has my permission to use my photograph, my child’s photograph, or any person’s I have registered photograph publicly to promote Wonders & Worries. I understand that the images may be used in print publications, online publications, presentations, websites, and social media. I also understand that no royalty, fee or other compensation shall become payable to me or anyone else by reason of such use.
I also confirm that I have shared this release and the above waiver with anyone I have registered and have permission to sign on behalf of that individual as well as their child.
